License and Scope: We grant you a limited, non-exclusive, non-transferable license to use our Services for your business needs, subject to payment and these Terms. Services include custom WordPress sites, SEO/GEO optimization, Google/Meta Ads campaigns, AI chatbots, and analytics reporting—tailored for clients across Australia and globally. Updates and revisions are included as specified in your quote.
3. Property Rights
Ownership: All content, designs, code, tools, and materials provided by JimmyTech (including websites, SEO strategies, and AI integrations) are protected by copyright and intellectual property laws. You receive a non-exclusive license for your use only; no ownership transfers.
Payments and Pricing: Prices are as quoted (AUD incl. GST). We reserve the right to adjust for scope changes. All payments are processed securely via Stripe or bank transfer. 50% upfront, 50% on delivery; Net 30 for retainers. Late payments incur 1.5% monthly interest.
4. Prohibited Activities
Unauthorized Use: You may not use our Services or site for unlawful purposes, including distributing malware, spamming, or violating laws. Do not misuse features like contact forms or chatbots for harassment or false information.
Reverse Engineering: You may not decompile, reverse engineer, or attempt to obtain source code from our deliverables (e.g., custom sites or AI tools).
Data Handling: All personal data is handled per our Privacy Policy and Australian Privacy Principles—no sharing without consent.
5. Services Management
Support and Revisions: Support is as outlined in your package (e.g., 2 weeks revisions for Growth tier). Inquiries via email or Contact form; response within 24-48 hours.
Termination: We reserve the right to terminate Services for breach of Terms (e.g., non-payment), with 7 days’ notice. You may terminate with 30 days’ written notice for retainers.
Refunds: No refunds for completed work or retainers; partial refunds at discretion for early termination (e.g., 50% if <50% delivered).
Changes to Terms: We may update these Terms by posting revisions here. Continued use constitutes acceptance. Check periodically.
AI Chatbot and Forms: Our chatbot and forms assist with enquiries but do not provide legal/financial advice. Messages may be stored for improvement; we prioritize privacy (see Policy).
